Terms of Service

These Terms govern your use of PhotoMoving ("the service"), an AI image and video generation tool. By using the service you agree to these Terms.

1. The service

You upload one photo, choose a style and model, and the service uses third-party AI models to generate a new image or video. Generation is asynchronous and may take from a few seconds to several minutes depending on the model.

2. Account

You must create an account to use the service. You are responsible for keeping your credentials secure and for all activity under your account.

3. Wallet and payments

  • The service uses a prepaid USD wallet. You add credit in fixed amounts via Stripe or Creem.
  • Each generation deducts a fixed amount from your wallet based on the chosen model. The price is shown before you confirm.
  • Failed generations are automatically refunded to your wallet.
  • Credit is non-refundable to your original payment method except where required by applicable law.

4. Acceptable use

You agree NOT to use the service to:

  • Generate content depicting real people without their consent, including deepfakes intended to deceive, defame or harm.
  • Generate sexual content involving minors, or any content sexualizing real people without their consent.
  • Create content that is unlawful, infringes intellectual property, incites violence, or promotes hatred or discrimination.
  • Circumvent rate limits, abuse trial/promotional credit, or attempt to extract model weights.

5. Content rights

  • You retain ownership of the photos you upload. By uploading you grant us a limited license to process them for the purpose of providing the service.
  • Outputs generated for you are yours to use, subject to the terms of the underlying model provider (e.g., Replicate or fal.ai model licenses).
  • You are responsible for ensuring you have the rights to the photos you upload.

6. No warranty

The service is provided "as is". AI output quality is not guaranteed and may contain artifacts or inaccuracies. We make no warranty regarding availability or fitness for a particular purpose.

7. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months prior to the claim.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms; remaining unused credit may, at our discretion, be refunded or forfeited if the termination is due to a violation.

9. Changes

We may update these Terms. Material changes will be reflected in the "Last updated" date above. Continued use after a change constitutes acceptance.
